Terms of Service

Applies to: www.torres-whp.com, including the /coach section (the “Site”).
By accessing or using the Site, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site.
1. Who we are; what the Site is
The Site is operated by Torres Workforce Health Partners LLC (“TWHP,” “we,” “us,” or “our”), a South Carolina limited liability company. The Site is informational. It describes our services and lets you contact us. Using the Site does not by itself create any client, coaching, consulting, or clinician-patient relationship.
2. Our services are provided under separate agreements
We offer, among other things: practice-growth coaching, a Practice Growth Audit, an 8-week Leadership Program for physical therapy practices, operations consulting, and workplace injury-prevention assessments and consulting for employers. The specific terms, scope, fees, timelines, and deliverables of any service are set out in a separate written agreement or Statement of Work that you and we sign. If that signed agreement conflicts with these Terms, the signed agreement controls for that engagement.
3. No professional advice; no relationship formed
Content on the Site — and general educational material we publish — is provided for general informational and educational purposes only. It is not physical therapy, medical, clinical, legal, financial, tax, or other professional advice, must not be relied on as such, and does not establish a clinician-patient or professional-client relationship. Clinical and business decisions remain your responsibility. Please consult an appropriately licensed professional for advice specific to your situation.
4. No guarantee of results
Coaching and consulting outcomes depend on many factors outside our control, including your own actions, your organization, and market conditions. We do not guarantee any particular result, revenue, cost saving, injury reduction, or other outcome. Any examples, benchmarks, or figures we reference are illustrative, not a promise of your results.
5. Intellectual property
All content on the Site and in our programs — including curriculum materials, frameworks, templates, assessments, roadmaps, text, graphics, and logos — is owned by TWHP or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to view Site content for your own informational use. You may not copy, reproduce, distribute, publicly display, resell, or create derivative works from our content or program materials without our prior written permission. Program participants receive a separate license to their materials under their enrollment or engagement agreement.
6. Acceptable use
You agree not to: use the Site unlawfully; interfere with or disrupt the Site or its security; attempt to gain unauthorized access; scrape or harvest data except as expressly permitted; misrepresent your identity; or use the Site to transmit harmful code. Please do not submit patient-identifiable health information or other highly sensitive personal data through the Site’s contact form or by email.
7. Third-party links and tools
The Site may link to or integrate third-party sites and tools. We do not control and are not responsible for third-party content, services, or practices; your use of them is subject to their own terms. See our Privacy Policy for the service providers we use.
8. Disclaimer of warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty as to accuracy, completeness, or availability, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, TWHP and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site will not exceed the greater of (a) the amount you paid us, if any, in the twelve months before the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless TWHP and its owner from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.
11. Governing law; venue
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in South Carolina for any dispute relating to the Site or these Terms.
12. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted with a revised effective date. Your continued use of the Site after changes are posted means you accept them.
13. Severability; entire agreement
If any provision of these Terms is held unenforceable, the rest remain in effect. These Terms, together with the Privacy Policy and any signed engagement agreement, are the entire agreement between you and us regarding the Site.
